Philippines’s “most wanted”

ERSTWHILE Comelec Commissioner Virgilio Garcillano is perhaps the most wanted man in the country today. In the heat of the controversy over the “Gloria-Garci” wiretapped conversations, Garcillano went into hiding and has not been seen since. The last time the public caught a glimpse of him was a month ago when he was interviewed on national TV over the tapes controversy.

Speculations as to his whereabouts have spread like wildfire. Earlier reports said he fled to Malaysia. He was next reported to be somewhere in Mindanao, probably in his hometown in Cagayan de Oro. One newspaper also reported that he was in Marawi City being coddled by Lanao del Sur Representatives Abdullah Dimaporo and Benasing Macarambon, but which the pro-administration congressmen vehemently denied.

Latest reports are now saying he’s been seen in one of the beach resorts in the surfing paradise of Siargao Island off Surigao del Norte. But other rumors circulating via SMS have it that he’s already flown to Singapore.

Citizens frustrated with the continued non-appearance of Garcillano have better seek assistance elsewhere as the government apparently is not keen in getting him to resurface. Despite a subpoena issued by the five House committees conducting hearings on the tapes, the pronouncement of the police officer in Cagayan de Oro that he has not received orders to monitor the former poll commissioner’s movements is disheartening.

Early on, Benjamin Abalos Sr., Comelec chairman, announced a probe on the electoral cheating being alleged in the taped conversations but the poll body has only been passively waiting for Garcillano to show up so the investigation can begin.  

With no immediate remedy forthcoming, can Garcillano, if he is still in the country, be subjected to a citizens’ arrest? Lawyer-blogger JJ Disini says that as this kind of arrest falls under warrantless arrests, under the Rules of Court, Garcillano can only be apprehended without a warrant on the following grounds: if he is in the act of committing an offense; a crime has just been committed and there is reason to believe he is the perpetrator; and if he’s a fugitive or escaped prisoner.

These are almost the same issues that the foreign affairs department are citing for not granting Sen. Aquilino Pimentel’s plea to have Garcillano’s passport cancelled — with the inclusion of a case of fraudulently acquired or tampered with passport.

In the event of a future Garcillano sighting, the next best thing citizens can do, Disini counsels, is to report his whereabouts to the authorities tasked with serving him the subpoena, or to the body that issued the subpoena, in this case, the House of Representatives. kung ako kay garci, di ko ipagkakatiwala ang buhay ko sa mga taong ang interes ay ang manatili akong tahimik. maraming paraan para matahimik ang isang tao. pero isa lang ang paraan para manahimik ang isang tao FOREVER. worse, the people who want him to remain quiet are generals. matakot ka garci. bilang na araw mo.

kung gusto mong mabuhay lumapit ka sa mga taong matitino na maari kang ma protektahan.

I was listening to the radio direct from the Philippines. It seems Garci had boarded the plane leading to subic bay. From there they have no idea where he went. Partly to be blame is the judicial system in the Philippines. They should have sequester his passport and send notices to every consulates in Manila that he is forbidden to live the country. Garci is the star witness, without him it will be all speculations and circumstancial evidence. I’m more concern of Garci’s life because without witness, there’s no case. If he end up at any morgue or missing in action most likely someone order his early demise. This is like the movie “Serpico” syndrome, murder is the only options in getting rid of the witnesses to cover up corrurtions.

the courts cannot be faulted for not sequestering garci’s passport. they cannot motu propio seize somebody’s passport without at least a case being filed against him. there is no such case pending in our courts.

the subpoena for his appearance was issued by a committee in congress. i’m not sure if they have the power to seize/cancel passports.

but if he has a red/gov’t passport. such should be canceled now that he’s out of government.

i dont understand why he cant be found.
if the government is hiding him then theres much reason to believe that it indeed is trying to keep him away from the prying eyes of the people.

anybody who’ve seen farenheit 9/11 would remember that when the tragedy struck the twin towers the american government readily evacuated all of osama’s kin in order to avoid being questioned by an independent investigative body.

i sincerely believe that hes out of the country.
mindanao has more than a million backdoors to begin with.

but enough of garci.
lets assume that we cannot find him.
the next step should be how to remove from office an estranged president without resorting to force.

“CIVIL DISOBEDIENCE”
what gandhi ascribed to as the most ownderful of all protests.
in our case i applaud the consecutive resignation of the different cabinet heads. but whats the use of resigning if they are not doing anything to continue topple the government?

the case here is to topple the government through civil disobedience.
we can stop paying our taxes thats a first.
we can stop following orders on traffic (with the number of people who has cars they can congest the highways with them.)
we can stop going to work altogether and have a celebration but not a rally.
or we can stay in the house and not use our electricity.

either way its a collective struggle that is Civil disobedience.
its fight from the heart and not from force.

its not people power.
but a power of one trying to stand up for what is right.
from there people would realize the change doesnt come from the system but from within.
and they would want nothing more but a better life.

I know that there is still good thing somewhere in the heart of Garci, He love his family and I know that he will not put all his loveones in danger and hatred of the people. Why not come out and tell the truth so everyone will have peace of mind and all these political turmoil will go to the graveyard.

To save his ass and the electoral process he helped to expose as anomalous anyway, why can’t the Senate or any other entity (not connected or beholden to the Arroyo regime) offer Garci immunity so that he himself can expose GMA and all those who wanted him to manipulate the elections, like Barbers (napakawalanghiya talaga pala nitong taong ito!) and in the process help this country reform the electoral process.

Something good must come out of Gloria’s perfidy, otherwise, we, as a nation, shall sink deeper.

What FVR, JDV, La Gloria, late FPJ, Sammy Ong, and Garcilliano are in common? All of them are natives of Pangasinan. May be Garci is hiding in said province, sa palaisdaan ni JDV.

Hindi naman kata-taka na di makita si Garci, eh kung si Janjalani di nila mahuli. Kapag nag-umpisa ang impeachment trial, palilitawin nalang nila na patay na sya tulad ng kay Abu Sabaya. Filipinos are not stupid, lahat ng scripts nila matagal nang nabili.

Kawawa talaga si Juan Dela Cruz, 48 years in gov’t service si Garci .. sayang ang pinasweldo natin sa kanya!!

OF COURSE, MAHIRAP MAKITA ANG HINDI HINAHANAP. PARA RIN YANG MAHIRAP GISINGIN ANG TAONG GISING AT ANG KAILANGANG PILITIN YUNG AYAW. KASI, KUNG GUSTO HINDI NA KAILANGAN PILITIN. DI BA?

THERE ARE REALLY SO MANY THINGS WRONG WITH A LOT OF THINGS IN OUR COUNTRY. THE STAND OF COMELEC VS. GARCI CAN BE LIKENED TO THE STAND OF OUR LOCAL BARANGAY WHEN I COMPLAINED ABOUT A NEIGHBOR WHOM I SUSPECTED STOLE MY WASHING MACHINE. THEY SERVED HIM AN INVITATION WHICH HE DID NOT HONOR. WHEN I SAW HIM, I IMMEDIATELY WENT TO THE BARANGAY HALL TO POINT TO HIM PASSING BY. THE KAGAWAD SAID, IT WOULD BE DIFFICULT TO ASK HIM TO COME BECAUSE HE DOES NOT WANT TO COME. GANO’N ?

All concerned citizens should watch out the whereabouts of Garcia and report immediately not to police or military (because they are also suspect on conniving with him during the election) but to lthe House investigating panel headed by Cong. Gilber Remulla. Thus, the subpoena will be served immediately and Garci be taken and cross-examined.

If I were Garci, I should come out and testify so that the truth will come out. If he continues to go hiding, I guess he will be killed to prevent his testimony in the Senate impeachment trial. He should act before he’s six feet under.

Calling all well-meaning citizens of the Republic, produce Garci now or else we will not forever know the truth about that farcical 2004 elections.

here’s one from former senator JOnny Osmeña as quoted from ABS-CBN news.

“Osmeña said the President rigged election results in Pampanga, Tarlac, Cebu and other provinces in Visayas and Mindanao.

“In Cebu, where she makes such a big fuss over her alleged 1, 085,000 votes majority, she padded the election returns by 460,000 votes,” Osmeña said. ”

Kung papakinggan n’yo ‘yung tape, nagrereklamo si Garci na ‘yung mga taong assigned sa Tawi-Tawi ay hindi marunong [mandaya] (If you will listen to the tape, you will hear Garci complaining that the people who were assigned in Tawi-Tawi don’t know how to cheat),” Osmeña said, referring to the alleged wiretapped conversation between Mrs. Arroyo and former Commission on Elections commissioner Virgilio Garcillano.

Nakalulungkot isipin na ang isang kagaya ni Garcillano ay masangkot sa nakapanlulumong katiwalian sa ating gobyerno. Nakapanghihinayang na ang mga taong nagsunog ng kilay sa pagtuklas ng talino, ay sila pa ang tuwirang yumuyurak sa karapatan ng mga taong kapos sa pinag-aralan. Dapat sana’y sila ang magsasanggalang sa ating mga kababayang humihingi ng katarungan, subalit sila pa mismo ang pasimuno ng mga katiwalian. Dalawang bagay lang ang maaring pangarapin ng mga taong api para sa kanya… Ang makita siyang isang malamig na bangkay na pinagpipiyestahan ng mga asong ligaw sa kalye..at maging ang kanyang pamilya ay hindi rin makaliligtas sa pagkutya at pag-alipusta ng sambayanang Pilipino na tuwiran niyang niloko. Many of us knew that the opposition will be cheated comes election period. I knew that the incumbent Administration will be able to successfully hatched that plan. Thanks to the mastermind who ordered ISAFP and to T/Sgt Noble and company who wire-tapped GMA-Garci conversations, corrupt that they may seem to be, that they sold the tape to the opposition. Buti na lang hands-on President si GMA that she was caught on the tape, otherwise, she should have had asked an her unidentified political operator to respond or to call GARCI to check on the status of their dagdag-bawas operation.

Let us assume that GARCI will no longer come out. He has with him a can full of worms that will implicate the GMA and her cabals, including perhaps a few from the opposition to election fraud. Let the impeachment begin and continue the pressure to make GMA resign or be ousted.

Let the impeachment court and other investigative bodies summon all those people identified in the “hello garci” tape. I hope they have not been made to disappear (kidnappped) too. Invite and get the expert and credible opinion those who have already authenticated the tapes to the hearing. And I know the truth that we already know will come out.

It’s time for GMA to seriously come up with a exit plan. Good by GMA.

DFA cannot cancel Garci’s passport, but immigration can revoke his travel. Would this be stepping beyond the immigration authorities power? If yes, then why does immigration check if you have enough funds to travel abroad, or if you have proper POEA documentation before you leave? Gimmick to extort (lagay) money from us?

Even if Garci had a passport, immigration could have banned, or at least prevent, his travel if they wanted too.

Talagang, pinatago muna si Garci para hinde maka-pag witness… Either way, its GMAs attempt to cover up her lies…… I am wondering why the TV and Radio outfits were not ZEROING on this one. I am really saddened by the Media’s in-attention on this angle to the point that they are an accessory to GARCI’s disappearance.

Baka naman pang-reserba lang ni GMA si GARCI – like eventually he would come out and deny everything and accuse the OPPOSITION in manipulation. O, kaya he will be used for another MORO-MORO skit, like “kidnap me-rescue” type ala “adong mahusay” and “sgt. doble.”

Or, they must be very busy, re-creating the Mother of all tapes???

alam nyo, si Garci parang si Doble rin yan eh, working both sides….nandaya siya para sa administrasyon at para sa oposisyon…teka maiba ako maisingit ko lang, malamang na-onse ng malakanyang si Lacson sa pangakong babayaran siya wag lang umatras sa kandidatura niya last election para mahati boto ng oposisyon, tapos di tumupad ang oposisyon kaya hayun inilabas na niya yung tape…ano sa tingin nyo…kung ako si Erap ni na ulit ako magtitiwala kay Lacson, minsan na siyang inihulog….
