Nature of Issue Issue Recommendation
Unresolved claims and disputes a. SHEPI demands payments of energy fees. Outstanding issues with Binga Hydroelectric Plant, lnc. (BHEPI) will have to be resolved before any future plans for BHEP (i.e., ROL contract or privatization) will be undertaken by NPC.
  b. NPC asserts that there was an overpayment of energy fees due to inclusion of value added tax in the energy billings of BHEPI.  
     
  c. NPC claims that BHEPI's meters are defective and that BHEPI's  claims for unpaid energy fees is  overstated.
In the view of the long-standing dispute between NPC and BHEPI, DOJ should look into the issue of unresolved claims and dispute.
     
  d. NPC claims liquidated damages from BHEPI of US$4.402 miIlion for the delay in the operation of BHEP and non-completion of rehabilitation works.  
     
  e. BHEPI's subcontractors and employees have various outstanding claims from NPC.
